Terms of Service

By accessing or using the ScholarKey by LMK Consulting platform and services (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service. These Terms apply to all users, including students, parents, and guardians.

If you are under 18, a parent or guardian must review and agree to these Terms on your behalf.

LMK Consulting provides a college-admissions support platform that connects students and families with LMK Consulting admissions advisors. The Service includes a family portal, essay tools, messaging, and reporting features designed to assist in the college application process.

LMK Consulting does not guarantee admission to any educational institution. Outcomes depend on many factors beyond our control, and advisory services constitute professional guidance, not a guarantee of results.

• You must provide accurate, complete, and current information when creating an account.
• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
• You must notify us immediately at lmk@lmkconsulting.com if you suspect unauthorized access to your account.
• Accounts are non-transferable. You may not share login credentials with third parties.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Submit false, misleading, or plagiarized content, including essay material that misrepresents your own work.
• Attempt to gain unauthorized access to other accounts, systems, or networks.
• Reverse-engineer, copy, or distribute any part of the platform without written permission.
• Use the platform to harass, threaten, or harm any user, advisor, or staff member.

All platform content, design, software, and trademarks are the property of LMK Consulting or its licensors and are protected by applicable intellectual property laws.

You retain ownership of content you submit (such as essays and profile data). By submitting content, you grant LMK Consulting a limited, non-exclusive license to use that content solely to operate and improve the Service on your behalf.

Access to certain features of the Service may require payment of fees as described in your enrollment agreement with LMK Consulting. All fees are non-refundable unless otherwise stated in writing. We reserve the right to modify pricing with 30 days' notice.

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we determine, in our sole discretion, that termination is appropriate. You may terminate your account at any time by contacting lmk@lmkconsulting.com.

Upon termination, your right to access the Service ends immediately. Provisions of these Terms that by their nature should survive termination will do so.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. LMK CONSULTING DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, LMK CONSULTING AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.

We reserve the right to update these Terms at any time. We will notify you of material changes by email or by posting a notice in the portal. Your continued use of the Service after the effective date of any update constitutes acceptance of the revised Terms.
